DN-1: Surplus District Property

(Seven-Director Districts NOT Located Totally or Partially within St. Louis County)

The district purchases property with public funds to further the educational mission of the district, and the Board expects district employees to care for and use district property efficiently. When the district no longer needs property or the property is not suitable to the district's needs, the Board, by an affirmative vote of a majority of the whole Board, may authorize and direct the sale or lease of the property in accordance with law.

Real property may be sold or leased by listing the property with one or more real estate brokers and paying a commission upon such sale or lease. Real property not disposed of in this way may be sold or leased to the highest bidder. Personal property may be sold or leased to the highest bidder or otherwise disposed of as allowed by law. Property may also be sold or leased for public uses and purposes to a city, state agency, municipal corporation or other governmental subdivision of the state located within the boundaries of the district. If the highest bid for such property is one submitted by an employee of the district, the Board may, at its discretion, refuse the offer and repeat the bidding process or retain the property. The Board reserves the right to reject all bids. If reasonable attempts to dispose of surplus properties fail to produce a monetary return to the district, the superintendent is authorized to dispose of them in the manner most advantageous to the district.

The superintendent or designee shall create administrative procedures to implement this policy in accordance with state law on the sale of surplus property. Surplus property that may be classified as “junk” or “scrap” may be disposed of by the superintendent and so reported to the Board.
